Terms of Service

Version 2026-10-22, in force from 22 October 2026.

In short.

  • Tellvault is software for businesses. It is not for consumers.
  • It helps you show AI transparency notices and keep a record of what you did. It is not legal advice and it can't guarantee that you comply with any law.
  • You can cancel a subscription at any time. It ends at the end of the period you've paid for.
  • Our liability is capped at what you paid us in the last 12 months.

This summary is for convenience. The numbered terms below are what apply.

1. Who we are and who can use the service

  1. The service is provided by Your Name, Street 1, Riga, LV-1000, Latvia ("we", "us"). Contact: hello@tellvault.com. Full details are in the legal notice.
  2. The service is only for businesses, organisations and professionals acting for their trade, business or profession. By creating an account or buying a plan, you confirm that you are acting in that capacity ("you", "the customer") and that you may bind the business you act for. Consumer protection rules that only apply to consumers, such as the right of withdrawal, do not apply.
  3. These Terms and the Data Processing Agreement (DPA), which is part of them, form the contract between you and us. You accept them when you tick the box at checkout, or by using the service.

2. What the service is

  1. Tellvault provides software tooling: a free website scanner; an embeddable script ("widget") that shows a notice that visitors are interacting with an AI system; a hosted transparency page; a dashboard where you record your AI systems, vendor confirmations and reviews, with PDF export; monitoring that re-checks your site; and the Evidence Pack, a one-time download of static files and a dated PDF.
  2. What is included in each plan is described on the pricing page at the time you buy. Features marked "coming soon" are not part of the plan until they are released.

3. What the service does not do

  1. No legal advice. Nothing in the service, our website, our emails or the texts we provide is legal advice, and no lawyer-client relationship arises. Notice texts, guides and checklists are general starting points.
  2. No guarantee of compliance. We do not promise or warrant that using the service makes you compliant with the EU AI Act (Regulation (EU) 2024/1689), the GDPR or any other law, or that it will prevent fines, warnings or claims. Whether and how a transparency duty applies to you depends on your facts. You remain responsible for that decision and for your own legal obligations.
  3. Limits of the scanner and monitoring. They read publicly reachable page code at the moment of the check. They can miss chat interfaces inside frames or apps, behind logins or loaded only after interaction, as well as voice, email, phone and other channels, and AI-generated or manipulated content (deepfakes). A "nothing found" result does not mean there is nothing to disclose.
  4. Your inputs. The record and the hosted page show what you enter. You are responsible for checking that it is accurate and complete, and that notice texts and translations suit your use. Translations we provide have been reviewed with care, but you should have them checked for any language that matters to you.

4. Your account

  1. You sign in with a one-time link sent to your email address. Keep access to that mailbox secure. You are responsible for activity in your account and for the people you let use it.
  2. Give us accurate account and billing details and keep them up to date.

5. Plans, prices and payment

  1. Prices are in euro and exclude VAT unless stated otherwise. Payments are processed by Stripe. EU business customers with a valid VAT ID are invoiced under the reverse-charge mechanism where it applies.
  2. Subscriptions (Starter, Agency, add-ons) are billed in advance for each monthly or yearly period. They renew automatically until cancelled.
  3. Cancellation. You can cancel at any time in the billing portal in the dashboard. Cancellation takes effect at the end of the paid period. Fees already paid are not refunded for partial periods, except where these Terms or mandatory law say otherwise.
  4. Evidence Pack is a one-time purchase for one website. It is delivered as a download in the dashboard as soon as the payment is confirmed. It includes no hosting, monitoring or updates.
  5. Failed payments. If a payment fails, paid features pause until it succeeds. If it still fails after Stripe's retries, the subscription ends and your account returns to the Free plan.
  6. Price changes. We will email you at least 30 days before a price change takes effect. It applies from your next renewal after that date. You can cancel before then.

6. Free plan

The Free plan includes the scanner and the widget for one site in English, with a small link to Tellvault. We may change or end the Free plan with 30 days' notice by email.

7. What happens when a plan ends

  1. When a paid plan ends, the account returns to Free. The widget keeps showing the notice in English with the Tellvault link. Paid features, including other languages, the hosted transparency page and monitoring, stop.
  2. If you close your account, we delete it and its content as described in the DPA and the privacy notice. You can export your record as a PDF beforehand.
  3. Files from an Evidence Pack that you host yourself keep working; they do not depend on our servers.

8. Acceptable use

  1. Only add websites that you operate or that you are authorised to manage. On the Agency plan you may use the service for your clients' websites. You are responsible for having their authorisation, and they are not parties to this contract.
  2. Do not use the scanner or monitoring to probe, overload or attack websites. Do not try to get around rate limits, plan limits or security measures. Do not use the service for unlawful, misleading or infringing content.
  3. Apart from what the Agency plan allows, do not resell or sublicense the service.
  4. We may suspend an account that seriously or repeatedly breaches this section, after a warning where that is reasonable.

9. Content and licences

  1. You keep all rights in what you enter. You give us the right to host, process and display it as needed to provide the service, for as long as we provide it to you.
  2. You may freely use, copy and adapt the notice texts we provide, including after your plan ends.
  3. We grant you a non-exclusive, non-transferable right to use the widget and the hosted page on your websites while your plan is active. Static files from an Evidence Pack may be used indefinitely on the website they were bought for.
  4. Everything else in the service, including software, design and brand, remains ours.

10. Personal data

Our privacy notice covers the data we process for our own purposes, such as your account and billing. We process some personal data on your behalf, such as the requests from visitors' browsers that the widget needs and the names you enter in your record. For that processing, the DPA applies, and on data protection it takes precedence over these Terms.

11. Availability and changes to the service

  1. We aim to keep the service available but do not promise any particular uptime. If our servers are unavailable, the notice may not show until they are back.
  2. We may improve and change the service. We will not materially reduce the features of a paid plan during a period you have already paid for. If we have to, you may cancel and we will refund the unused part of that period.

12. Warranty

The service is provided as it is and as available. As far as the law allows, we give no warranties or conditions beyond those expressly stated in these Terms. In particular, we give none on fitness for a particular purpose or on legal compliance (see section 3).

13. Liability

  1. Our total liability under or in connection with this contract is limited to the fees you paid us in the 12 months before the event giving rise to the claim. If that amount is lower than €50, including on the Free plan, the limit is €50.
  2. We are not liable for indirect or consequential loss, lost profits, revenue or goodwill, or loss of data that regular backups or exports on your side would have prevented. We are also not liable for fines, penalties or damages imposed on you for your own legal obligations, or for claims about your website by third parties.
  3. These limits do not apply to liability for intent or gross negligence, death or personal injury, or any other liability that cannot be limited by law.
  4. You will compensate us for third-party claims caused by content you enter, by your breach of section 8, or by your use of the service for a website you were not authorised to manage.

14. Term and termination

  1. The contract runs until your account is closed. You may close it at any time.
  2. We may end the contract with 30 days' notice by email. If we do, we refund any prepaid fees for the time after it ends.
  3. Either party may end it immediately if the other materially breaches it and does not fix the breach within 14 days of being told about it.

15. Changes to these Terms

We may update these Terms and the DPA. We will email you at least 30 days before a material change takes effect, and you may cancel before then. Changes that are needed because of a change in law, or that do not disadvantage you, can take effect sooner. The version and date are shown at the top. A new version is also shown at your next checkout.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of Latvia with jurisdiction for Riga have exclusive jurisdiction. We will always try to resolve a problem by email first.

17. Other terms

  1. If any part of these Terms is invalid, the rest stays in force. The invalid part is replaced by a valid one that comes closest to its purpose.
  2. We may transfer this contract to a company we set up or control to run the service, and we will tell you if we do. You may not transfer it without our consent, which we will not refuse unreasonably.
  3. Notices are given by email to the account address, or to hello@tellvault.com. These Terms are written in English, and the English version prevails over any translation.
